Thank you for using RetailGPT. These Terms and conditions of Service (the "Terms") are intended to make you aware of legal rights and responsibilities with respect to your access to and use of the RetailGPT and any related mobile or software applications ("RetailGPT Platform") including but not limited to delivery of products via the Platform whether existing now or in the future that link to the Terms (collectively, the "Services").

“Delivery Service Partner” refers to independent third parties, who are onboarded onto the RetailGPT ecosystem platforms, exclusively developed by the Company, to assist the Retailers in the Delivery of services.
“Payment Gateway Partner” refers to independent third-party service providers facilitating secure online payment transactions for purchases made by Shoppers.
“Retailers” refers to businesses registered with RetailGPT to offer their products or services for sale to Shoppers.
“RetailGPT” refers to the platform developed and operated by Pathfinder, enabling Shoppers to browse, purchase, and interact with products or services offered by Retailers.
“RetailGPT Ecosystem” refers to the RetailGPT platform and any external applications, modules, or services integrated into the platform. This includes third-party tools, Delivery Management Platforms, integrated into the platform and also includes Ecosystem Partners enrolled on RetailGPT platform such as Delivery Service Partners and Payment Gateway Partners, all collectively functioning to enhance retailer operations.
“Services” refers to the services offered by RetailGPT as set out in Clause 3 of this Terms. The reference to “Service” shall also include references to any features, facilities or tools added to the Services in the future and such additions will also be subject to these Terms.
“Shoppers” refers to individuals using RetailGPT to explore, purchase, and engage with products or services offered by Retailers.
“we”, “us”, “our”, and “RetailGPT”, refers to the RetailGPT platform and the contracting Pathfinder entity.
“You”, “User” refers to the Shopper accessing or using RetailGPT’s platform and services.

4. Account Registration and use of Services:

Shopper(s) can access the RetailGPT platform, create an account and register using their mobile number, email or via any other means as prescribed by RetailGPT platform. The account created and registered by the Shopper shall hereinafter be referred to as “Shopper Account”.
If the Shopper creates the account using the credentials of a third party (including, but not limited to, Facebook, Instagram, Google account, etc.), the Shopper hereby gives RetailGPT the absolute and unconditional right to access and use such 3rd party credentials for operating the Shopper Account.
By creating an account, you agree to receive transactional emails, notifications, and updates from RetailGPT related to your orders and account activity.

RetailGPT reserves the right to suspend or terminate any account that violates these Terms or engages in unauthorized or unlawful use of RetailGPT.

Using the Shopper Account, the Shopper can view the catalog of Retailers, and browse, search for, and place orders for products and services with any Retailer of their choice.

Payments for orders shall be processed between the Shopper and the Retailer through third-party payment gateway partners integrated into RetailGPT. RetailGPT does not handle or store your payment information.
Payment Methods: During the checkout process, you may select from available payment methods, including credit/debit cards, net banking, or other payment options provided by the chosen payment gateway partner.
Transaction Security: RetailGPT is not responsible for transaction security or processing errors that may occur with the selected payment gateway, including but not limited to any transactional failures.
Tax Responsibility: The Retailer is responsible for ensuring compliance with applicable tax laws and for remitting taxes to the relevant authorities. RetailGPT does not handle or manage taxes related to the transaction nor shall it be liable for any tax related disputes and claims.
Refunds and Adjustments: In the event of any returns, the corresponding refunds shall be processed by RetailGPT in accordance with the RetailGPT Returns and Refund Policy. Refund Policy Notwithstanding the foregoing, the Retailer shall remain solely responsible for the payment of any refunds. RetailGPT shall not be liable for any delays, failures, or discrepancies in the processing or payment of refunds.

All registration information you submit is truthful, lawful and accurate and that you agree to maintain the accuracy of such information.
You are solely responsible for all activities conducted through your RetailGPT account, including all content published or displayed through the account, any email messages, and interactions with other users.
You will abide by all applicable local, state, national, and foreign laws in connection with their use of RetailGPT.
You will not use RetailGPT in any way that is unlawful, or harms us or any other person or entity, as determined in our sole discretion.
You will not post, submit, upload, distribute, or otherwise transmit or make available any software or other computer that contains a virus or other harmful component, or otherwise impair or damage RetailGPT or any connected network, or otherwise interfere with any person or entity's use or enjoyment of RetailGPT.
You will not use another person's username, password or other account information, or another person's name, likeness, voice, image or photograph or impersonate any person or entity or misrepresent your identity or affiliation with any person or entity.
You will not engage in any form of antisocial, disrupting, or destructive acts, including " flaming," "spamming," "flooding," and "trolling," " as those terms are commonly understood and used on the Internet.
You will not discriminate against any Retailers, or Delivery Agents, based on race, religion, caste, national origin, disability, sexual orientation, sex, marital status, gender identity, age or any other metric which is deemed to be unlawful under applicable laws.

If a Shopper provides incorrect information, is unresponsive, unreachable, or otherwise unavailable for the fulfillment of the services offered by the Retailer, it shall constitute a breach of the unconditional and irrevocable authorization provided at the time of placing the order. In such cases, the Retailer shall be entitled to claim liquidated damages from the Shopper, equivalent to the value of the order. RetailGPT bears no liability for such breaches or disputes.
