this policy statement, shall be construed as reference to Retailer(s) and Shopper(s).
Services shall mean the Services as defined in the respective General Terms and Conditions of Use and the Master Service Agreement. By downloading, accessing, registering, and using the RetailGPT
platform (“Platform”), You acknowledge and agree to be bound by the terms and conditions of this Privacy Policy. Furthermore, you expressly consent to the collection, use, processing, storage, and disclosure of your personal information and any other information as specified herein, by the Company in conformity with the provisions, and purposes outlined in this Privacy Policy.
If You do not agree to any of the terms herein, You must immediately cease use of the platform. This policy is a part of and is to be read along with the General Terms and Conditions of Use and Master

process, store, and share such information solely for the purposes outlined herein and subject to the terms provided herein.

1.1.2. Personal information may also be collected when Users sign in to the RetailGPT platform using third-party credentials, such as Google or Facebook. By utilizing this functionality, the User expressly consents to the transfer, disclosure, and sharing of their personal information between the respective third-party platforms and the RetailGPT platform. The User further consents to the use,
processing, and storage of such personal information obtained from third parties by the Company.

2.1.11. Performing internal operations necessary to provide our Services, including troubleshooting software bugs and operational problems, conducting data analysis, testing and research, monitoring and analysing usage and activity trends;

By availing these services, you acknowledge and consent to the sharing of your personal information, including but not limited to your contact details, delivery address, and payment-related information, with the respective Delivery Service Partners and Payment Gateway Partners, as necessary for the seamless execution of delivery and payment transactions.
3.1.2. Judicial, Statutory and Regulatory Parties:
3.1.2.1. We may disclose User data to judicial, statutory, or regulatory authorities, including law enforcement agencies, in response to a lawful request, subpoena, court order, or as otherwise required by applicable law.
3.1.2.2. Prior to such disclosure, the Company shall make reasonable efforts to notify the User of the lawful disclosure of their data, wherever such notice is permissible under applicable laws and regulations.
3.1.3. Third-Party Service Providers:

3.2.1.In the event of a change in the management or control of the Company, whether arising from a merger, acquisition, corporate restructuring, or sale of assets, your personal information, along with other data collected under this Privacy Policy, may be transferred to the acquiring entity, successor/surviving entity.

The User has the right to request that their personal data be forgotten without undue delay, where the personal data is no longer necessary for the purposes for which it was originally collected or processed.
4.1.3. Restriction:
You can restrict the processing of your Personal Data by opting out, where an opt-out option is available in respect of such information.
4.1.4. Right to withdraw consent:
You may withdraw their consent for the processing of their personal data at any time, where such processing is based on consent
4.1.5. Action for Violation of Data Privacy:
You have the right to lodge complaints with the relevant data protection authority if you have reason to believe that your rights under applicable data protection laws have been violated or if you have suffered harm due to the unlawful processing of your personal data.
4.2. Any request(s)made under this clause, will be processed and closed by us, within 7 days from the date of receipt of such request.

The Company shall not, under any circumstances, be liable to the User (or to any third party claiming under or through the User) for any indirect, special, incidental, consequential, or exemplary damages arising from the User’s use of, or inability to use, the Platform. This exclusion includes, without limitation, any claims for lost profits, lost data, loss of goodwill, work stoppage, computer failure or malfunction, or any other commercial damages or losses, whether or not the Parties were aware of the possibility of such damages. In jurisdictions where the exclusion or limitation of liability for consequential or incidental damages is not permitted, the Company’s liability shall be limited to the maximum extent permitted by applicable law in the relevant jurisdiction.
14.2. Disclaimer:
14.2.1. The Company shall not be responsible for:
14.2.1.1. Any activities or transactions conducted through the User’s account.
14.2.1.2. Any unauthorized access and use of the User’s account, where such unauthorized access is attributable to the User’s sharing of account credentials, including access and use by minors.
14.2.1.3. The use of the Platform for purposes other than those expressly outlined in the Terms of Use;
14.2.1.4. Any misuse of data (including intellectual property data such as marks and logos) by other enrolled users, including users engaging in transactions with each other and/or interacting with each other on interactive chat rooms, instant messaging and blogs;
14.2.1.5. Any breach or violation of privacy by third-party websites.
15. Data Protection Officer:
15.1. The Company has appointed a Data Protection Officer (DPO) responsible for overseeing the implementation of this Privacy policy and the data protection strategies specified herein. The DPO shall also be responsible for ensuring that this policy is in compliance with the requirements prescribed in applicable Data Protection laws.
15.2. The DPO shall also be responsible for handling any User requests, including requests for removal, deletion, erasure made under this policy.

Any such amendments will be notified to you through the Platform at least five (5) business days prior to their effective date. If you do not accept the amended Privacy Terms, you must immediately cease using RetailGPT. Your continued use of RetailGPT, following any modifications, updates, or amendments to the Privacy Policy, shall constitute your acceptance and agreement to be bound by revised policy, regardless of whether you have reviewed them.
